Brooke M. Matney

Brooke Matney is an associate for Matney Legal Group. Her practice focuses on strategic patent counseling, patent prosecution, and portfolio development. Brooke specializes in partnering with both early stage and mature companies in the pursuit of their business objectives through individually-tailored portfolio development and value maximization strategies. She has extensive experience advising clients on freedom-to-operate, validity, infringement, ownership, and licensing issues. Informed by her years as a patent examiner at the U.S. Patent and Trademark Office, she provides meaningful patentability assessments and practical guidance for successfully navigating the patent examination process. Brooke has also developed and assessed pre-litigation and litigation strategies and counseled clients with respect to intellectual property due diligence issues associated with corporate transactions and filings.

Much of Brooke’s practice is concentrated on medical applications including, for example, drug and fluid delivery, surgical devices, implants, diagnostics, ingestible electronic medication, robot and image-guided surgery, radiation treatment, wearable devices, and electronic prescription management. Brooke also has experience working with clients in high-technology computer and electrical industries, including consumer electronics, wireless communications, cybersecurity, machine learning, and software development. Her patent prosecution and counseling practice also includes a variety of other technological applications, including retail and consumer products, musical instruments, and automotive technologies.  

Prior to joining Matney Legal Group, Brooke was most recently an associate at a top international general practice firm, where she worked in various patent practitioner roles from 2014 to 2024. 

Following in the footsteps of her father and grandfather, Brooke was an Examiner at the U.S. Patent and Trademark Office from 2009 to 2014. She examined patent applications in Art Unit 3763, which focused on medication delivery devices, catheters, and aspirators falling into Cooperative Patent Classification Subclass A61M: Devices for Introducing Media Into, or Onto, the Body. Specifically, she examined applications directed toward technologies including injectors, balloon catheters, insulin pumps, electronic medicine, and infusion devices. In 2014, Brooke served as a detailee to the Patent Trial and Appeal Board of the U.S. Patent and Trademark Office, performing ex parte appeal file reviews and analysis under the supervision of an Administrative Patent Judge. 

In 2023, Brooke was awarded the KINDness Matters Award by Kids in Need of Defense (KIND) in acknowledgment of her pro bono work representing unaccompanied minors in their requests for special immigrant juvenile status (SIJS).

Brooke earned her JD in 2017 from The Georgetown University Law Center and served as Development Editor of the Georgetown Journal of International Law from 2015 to 2016. She earned her BS in Mechanical Engineering in 2008 from the University of Virginia.
